Folks,
With the potential retrogression looming over the above E classes, was just wondering if someone knows how far these categories might retrogress.......a few weeks or months or a couple of years???? Does the consulate normally wait for the visa bulletin of the preceding month before scheduling an interview for the following month??
Thanks

case sent to consulate: 5/18/05
Consulate: Chennai
Interview Date:

You should be good to go!

I was looking at the numer of visas used for EB1 and EB2 during 2002 and 2004 at USCIS yearbooks. Both years, I think, they were somewhere near the annual quota of 39,000 visas (28% of 140K) each and rarely dug into the recaptured numbers. So, I believe your interview would be scheduled for Aug, if not already there in July. Did you check US Chennai website to see whether you are scheduled for July?

Things could change, I guess only, in Oct 2005, when the tsunami from the Labor BEC hits. But you are in good luck!

Best of luck!

Hanuman.

What is this Labor BEC that is expected to hit the availability in October, 2005. Please help me understand this.

Thanks

hi rkrishna
taht is the flood of approvals from Backlog Elimination centers (philadelphia, dallas) which is BEC, on the Labor certification that is very soon to follow. That will retrogress the EB2 and may be EB1.

I think on that one, it would depend on how many cases are EB2 Vs EB3. My feeling is it is more EB3 with some impact on EB2s as well

I don't think BEC will impact EB1 cases because they don't require the labor cert.

Lets see..

it is expected that BEC will complete processing all 2001 applications by the end of September 2005 but that is an optimistic shot in reality......

my guess is when FY 2006 starts in October, PD's for EB3 will be around early 2003 and then eventually retrogress further to 2002 as we have more and more LCA cases approved by the BEC. people who can get their GC's by the end of this year will be lucky folks because retrogression is going to really hit hard starting 2006.
