How does wife's AOS Processed ???

Hi,

I have filed my 485 an year ago (having EAD and AP), I recently got married and filed for my wife's 485 and EAD a month ago. I have the following queires:

1. Will my application be approved in the normal way as it does or there will be any delay in Application ?

2. Does my wife's processing going to take another year ?

Please Advice.

1. If INS links your wife's 485 with yours properly, it'll be processed together. And yes there will be a delay as your wife has to do finger printing and INS has to get her FP results back.

2. No. Both of them will be processed together.
 
I disagree with milli

They are two different applications. In case they get filed
together there is a chance that they both go thru processing
at the same time...
The application which gets filed first gets approved first(????)...and is not delayed because of your spouses app.
Your spouse will have to wait for her turn...
 
me and my friend did same thing. We both got approved independant of spouse case. Spouse
case is pending with INS. In our case, Both cases are handled differently.
 
If it is processed differently can you let me know the approximate time frames.

If my 485 is approved and i leave the job and if my wife receives rfe, what if my employer doesn't provide necessary documents.

the processing time of your wife's I-485 would be same as for any other normal I-485 application. It is hard to predict processing time of I-485

If you file I-485 of your wife as derivative beficiary and you file yours as primary applicant as employment beneficiary. Then only you have to provide employment related information. You wife only have to prove relationship with you in order to apply as derivative.

Your attorney would be able guide you with the exact requirements and document needed.
 
What about changing job before wifes AOS

Assuming that RGK did employment based GC & has recieved his GC but waiting for his wife's now. In this kind of situation is it possible for him to change the job before AOS of his wife? Or will he have to stick with the same company till even his wife gets AOS/485 completed ?

Say, if he changes the job and later an RFE is issued on the wife's case. what happens ??
 
I do not know the answer. But if I have to guess,
I would say dependant would not get RFE related
to employment.
