How do you get your driver license?

I went to DMV to renew my driver license today but was declined there.

I had a New York driver license when I worked on H1B status but now it's expired (Right now I am on B-2). I recently married USC and filed I-130/485/765 package. I think i should be able to get DL renewal coz i have at least 6 points. But the lady at DMV office told me that I could not get new DL unless my green card got approved by USCIS. It's so frustrated as it may take as long as one year to get my GC. It's pain if you can't drive during such a long time. DMV seems only to give DL for USCs or GC holders now...Does anyone have experience for applying for DL after submitting I-130/485? How did you guys get DLs? :confused:

You should have no problems getting it as soon as you get your EAD (I765)... You need that along witha social security number (thats 3 points) and it's up to you what else you want and can use for the other 4 points you need...

I had to use my EAD w/ SS card + Marriage certificate = 6 points.

Actually the EAD is 3 points and the SS card is 2 points. So all he will be needing is 1 point...a credit card would do for that.
 
The social security card is 2 points, but it is mandatory in NYS.
You must show it in order to go through.
Personal experience.... :mad:
Lose everything but not your social security card...took me about 4 months and a lot of frustration when I asked for a replacement.

EAD should always be accompanied with an SS card... Well that's how it is here in NJ atleast anyway...
 
It looks that DMV lady told me wrong. I don't need to wait the Greed Card. Instead, I can get DL as long as my I-765(employment card) approved. Is this true?

Yes you are correct The EAD card also can be a valid form of ID used to obtain DL in some states they require you to get SSC before DL, EAD can get you both!

My EAD may come in two months. it's long time, but it's better than wait for green card coming. Now I realize loosing driving privilege is pain...

Well in New York, they're also required but they count for 5 points, not just 3.
 
I would say go to another DOL office with SS card, EAD, utility bills, bank statement, credit card etc.

You will need all together six points (as a proof of identity). Check following link for details:

Thanks for advising. i have enough points, but the issue is DMV lady told me that i couldn't get DL until they saw green card approved. I believe what she said is wrong. i should be able to get DL when i have EAD.
 
Yes...

Once you have EAD, just go to another office. Hopefully you will get it.
