How do we know I-140 revoke requests?

Hi Folks


1. How does employee know whether his/her employer filed for I-140 revokation or not?

2. Will the Status on the BCIS Online webiste for I-140 is going to change after the revokation filed ? Normally we receive receipt notices once they have our applications and checks cleared at service centers, likewise if employer files for revokation will the status for I-140 change on online website the moment they have the revoke request?

3. How long will it usaually take to process the I-140 revoke petition filed by employer at VSC?

4. I guess I-140 revokation can be filed by employer with a retro active date, and if employer files after 180 days of I-485 receipt date and asks for revokation of underlying I-140 for a date effective which is before 180 days, is that a valid petition ?

5. and lastly, is 180 days counts based on Receipt date or Notice date of I-485 ?

If the employer revokes your I140 before it is approved (or) within 180 days of filing I485, then BCIS will reject your I485. The website will be updated and you will get the denial notice.
If the employer revokes I140 after approval and after 180 days of filing I485, then BCIS will send a RFE for you. Ofcourse, as per the new Memo by BCIS, they (BCIS) are supposed to send NOID (notice of intent to deny) to you unless you have submitted AC21 letter to them.
 
There is another flag

if your I-140 is revoked then it is *likely* that the EAD/AP applications will be denied. So in addition, if you have managed to renew your EAD/AP after the 180 day point, your I-140 has probably not been revoked.
