Hi, I am an Indian F1 Masters student and want to set up my tech company in the US. I have a full-time job offer as a software engineer at a FAANG company and I am starting at the end of this May. My employer has also applied for my H1B visa and will continue to do so in the future.
I want to start my business where I can consult companies on setting up software solutions with AI and Cloud. I also want to ship software products to the users. I have a consulting project and a prototype app that I built as a college project that I would like to bring to users and get paid for.
I am planning to do this part-time with my full-time job. I do not have any partners at the moment, I am the sole founder.
My questions are-
- What do I need to consider before registering a company in the US and how will this affect my future immigration process?
- Are there any specific business structures (LLC, Corporation, etc.) that are more favorable for my situation?
- How does the process change if my H1B visa gets approved?
- Do I have to get a concurrent H1B to get started and will I have to pay myself? Can I not pay myself and reinvest the total profit in the business?
- If I decide to go for an O1 visa will I be able to work full-time with my Employer and continue with my part-time business?
