How can I know if my I-140 was filed???

Does anybody know as to how I can be sure that my I-140 was filed by my employer? I am asking them for my receipt # (EAC) and they told me that they haven't received it yet. They filed it last June and as to what I know it should have been available by this date so I can track it. I have checked www.immigration.com
for the processing time for VSC and by this time it should have been available.

I don't know if they really filed it.

Another question with regards to I-140/I-1485 concurrent filing, if my employer doesn't want to avail of this for me, do I have the option to ask an immigration law firm to process it for me.

I hope somebody can answer this questions.

The employer can find out about their 140 petition. Or you can call the Service Center to find out about the procedure to track the case.. Usually it takes about 3-4 days to receive a notice with EAC numbers in it.

The applicant files for AOS. Most of the time the company does it for you but you can also do it yourself. All you need is a job confirmation letter and copy of the courtesy receipts ( change of status, H1, I 40) from them. You should have them either way just in case. The procedure is so straight forward that I dont know why people pay thousand bucks for lawers!!!

Although I know that it won't take too long to have the receipts, I don't know as to why my company is saying that they don't have it yet. What I'm thinking is that they don't want to give to me or they haven't filed it yet. Is it OK to contact INS to ask for status of my papers without having a specific receipt? I ask this because from their website it states that I must have the receipt in order to ask specific about my case.

As for I-485 filing, don't I need to ask consent from my company before doing it or just file it without them knowing it?

You can call the INS service center to find out about the case. Most likely they will ask you whether you are the petitioner or the beneficiary. You can ask the employer when they sent it and track it from there....

For the 485 process, you can apply yourself. Its that simple. You just need the copies of the 797's from your employer. In respect to informing them,,, I think if they are paying then they should know otherwise,,, why bother? thats my take..
