does anybody know how is the approval of AC21 cases recently? What both the individual and new employer need to do to ensure the smooth green card journey? any comments will be highly appreciated.

I am declining a job offer

and at last give up AC21.

Trust me those officers do not know AC21 as much as you do. So they may fully ignore AC21 and send you "intend to deny" notice.

Scary? It was for me.

Did they send you intent to deny notice?

Unless and untill you are bound to use AC21, there is no need for you to go with the AC21 Road.

But one thing is that if you have good attorney to support, and people are in tough situation, then they can definitely use it.

So Just dont scare the people in the forum.

It depends on case to case basis.

As some people have used them and got approved without any probs.

215nj don't worry.

I got approved on Nov. 21, 03. AC-21 case, changed job/residence exactly on 181st day. Moved from VSC to TSC. Got rfe for standard stuff. And finally got approved. I also had I-140 approved for CP.

I have posted all the details in an earlier message.

I used AC-21 and got approved last month. The story is

RD is Jan 2002. Invoked AC-21 on Aug 2002. Moved to NSC jurisdiction. Informed INS with new employment letter. Salary is 13k less than the labor one. But labor is approved from NJ state. Still my wage is more than the standard wage but less than the labor one. File AR-11. Got an RFE on Sep 2003 for new employment letter and paystubs. INS received my reply on Oct 2003 and got approved on Nov 19th 2003.
