How 485s are processed

Can someone please let me know how or in what order the concurrent 140s-485s are or do get processed? I mean does 140 getw worked upon first and then they act on 485 or how does this concurrent thing work?

Also in regards to other applications being filed how are 140/485 processed, Is it based on PD or when those forms are received in by USCIS. I have a PD Nov-2002 and my labor got approved in mid june and all the paperwork was delievered on 7/3 to USCIS at TSC.

That is one of the mysteries of the universe. USCIS does whatever they want in some unknown order. The only thing we know is that an I-485 cannot be approved until and unless the underlying I-140 is approved. Sometimes they approve both at the same time, sometime they approve the I-140 very quickly and then you wait years for the I-485 to get approved.

I couldn't file premium since it was on temp hold for the month of July when USCIS was expecting lot of applications to be filed.

However with new annoucement, I don't know if premium 140 will ever come back soon,

What do you think of it?

Arn't 485 done according to PD of the labor.We filed our I -140 on 07/28 got approved on 07/17 Premium Processing.

I485 processing sequence ...

Status of I-140 plays a role in abdujication of i485. Although USCIS processes are prone to exceptions.

In fact if you file 485 at different service center (say TSC), than prior to processing the service center (TSC) would ask for i140 file from where ever the i140 was filed (say NSC). This came up during my discussion with lawyer as I was forcing her to file 485 at TSC which churns out cases at faster rates than NSC.

What would be good is, and people who have gone thru this deliema can do authortatively, is list the steps or toll-gates they went thru after I485 filing and till getting approved.
 
PD only determines if you are allowed to file the I485 within a given month, or if your case can be approved within a given month. Once that criteria is satisfied, there is no set pattern to the order of processing the pending cases, although there is a sometime-ish trend of processing by the 485 receipt date. But it is not consistent by any means, because some people who filed their I485 in 2007 have been already approved, and others are still waiting from 2003.

My openion would be they might not consider any more PD now.

Since just think about the cituation, some people who's I-140 already got approved with PD 2005, 2006, some one I-140 not yet approved and they have to wait in I-140 Queue.

USCIS have to allot vis a number as they have pressure to use the visa number this yera or next Financial year before Next year end.

So they have to adjudicate case ASAP, First they have to see I-140 approved , Security check are cleared, they will give give Hig Priority to case which is ready for Approval, rather then wait for PD whos' PD is 2003 whis is waiting for I-140 approval and security check.

Now currently som many people are getting approved in Mid 2004 and late 2003, then some one are waiting still in 2002, beg. of 2003.


So no More PD Now.Better to use approved I-140,Also you cann see many EB2 approvals in coming months, since they have approved not As much as Eb3.

So Eb2 approval Date might move fast in PD 2005 and 2006 with whoever gor approved I-140.

I disagree with satish_hello.

I believe the USCIS filters all the cases on basis of PD and starts working from bottom first. However, in order for the case to progress forward all the stipulated formalities have to be completed. If true, the case progresses forward. Else, the cases is deferred untill required fomality is completed. At the point the case would be resurrected and pushed forward to next logical step. While the case is in deferred state, the next cases is passes thru same parameters and so on.

I can visualize bunch of government employees working with stack of files working

Hi BECsufferer,

Then explain me how this is happening, few cases filed I-485, in 2007 and so many cases who filed I485 in 2005, 2004 with older PD VS Other case with late PD who's formality also completed ready for adjudicated, Here who get's first.

And more over , there was no FIFO in BEC also, I am telling you there is no rule for USCIS.Are they going by rule quota for Eb3 and Eb2 , i don't think so.

And i have not seen many approvals EB2 in 2003,2004,2005. That means all the backlog labour have not ported the DATE to their EB2-PERM. As you know almost everyone who got stuck in BEC,has PERM-EB2.

Where is the Porting happening, since EB3 approval rate going on well, everyone are happy with their EB3, so many cases left not further processing in BEC as well as in PERM.

USCIS want to keep EB3 cleaned fist then they can make cuurent both Eb3 and Eb2.

Also mostly now Eb2 is current since not so many people are in Eb2.

this is my just my openion.
