:( Hostile situation for Experience Letter in 140

Hi,

I am in the same situation as you. I have like more than 8 years of experience. My previous employer is not giving me expereince letter and he is hostile to me. I am in a unique situation where in My current employer is also dealing with the same lawyer as my previous employer. While appling for Labour, I had the same problem and tried my level best to get the experience letter but in vain. He doged me for more than 2 months saying that he would think about it and let me know. He just made me run around and I also made thousands of calls to even India when he was there. Some how I managed and convinced my Lawyer to accept affidavit letter from my co-worker and that worked out and got my labour approved on Feb 2006. Now I need to apply for I 140 and Lawyer is saying that he can not submit the I 140 with out my previous employer's experience letter. I am sitting ducks and my H1 expires 6 years in September. Please advice and let me know how did u guys managed.

Employer A (From India) - 2 years. Got experience Letter
Employer B (USA- Indian Employer) - 5 years - No experience Letter
Employer C (USA- Indian Employer) - 1 year - Current Employer.

But I got all my W2's and paystubs which my lawyer is saying is not useful. Any insight would be appreciated.

You do not need experience letter to file I- 140. Your CV indicating experience and appropriate dates and filling in that information on accompanied immigration form is enough.

I think you can file GC through other lawyer if you can pay your own.
I filed NIW without experience certificate and I 140 is approved in 15 days at TSC. If you get recommendation letters about your work that is good enough.

Your H1B visa papers must have a job description and employment dates, that should be fine. Any way you will need to put copies of all that with I-140.

Affidavits are fine for I140

guys, Affidavits are fine for I140 filing. I just confirmed with one of my friend who got his approval recently from TSC. hope it helps.
 
Experience letter for PERM

Hi all,
I'm palnning to apply for labor.I dont have experience letter for 2 of my past employer.Those companies did not give me the exp letter.I have a letter from my collegues who worked with me in thos companies.Do those ppl have to be my supervisor to issue the experience letter (or) is it preferable to get it from the supervisior?

I dont know where my former superviors are and have letter only from my collegues who worked in that company.

Will this be enough? I also checked in another forum and someone has posted a msg saying that experience letter from 2-3 former collegues will also be advisable....

Can somebody help me on this.
