Hopeless in my LC approval??

Hi, I am a new member and have spent a lot of time reading old messages here.

My lawyer told me I absolutely have no chance to get LC approved under current economy, since I am fresh out of school and my current job requires no working experience. I also read similar discussion about people fresh out of school applying GC.
Is it true??

So all I can do is to wait for economy to get better and maybe change my job after a couple of years? I really like my current job though. Any suggestions of what I can do now?

I'd like to ask other lawyers' advice too. Anyone knows a good lawyer in Minneapolis, MN?

I agree that it would probably be very difficult to get an LC approved for a position that requires no experience and since your current position requires no experience, it is probably out unless the economy improves drastically. You need to get some experience and then you will have 2 options:

1. Find another job with another employer and file for that position.

2. File for another position within the company that does require experience. This is not particularly easy to do and it must be planned for when you file the LC but it can be done in the right circumstances.
 
I don't quite understand the second option. What are the tricky things there?

So I should be promoted to a senior postion that requires some experience after 2 or 3 years. But it should be presented like my company has a senior position open and happen to fill it with an internal employee (me, in this case)?? Then I can file LC with that senior position?

So in that case, does my experience in the 2/3 years count? It is still within the same company, but towards a position that requires experience.
 
It's really impossible to give specific information regarding this type of thing in this forum. It is so case specific, the nature of both positions and internal corporate hiring go into the consideration for this type of thing. I've read dozens of BALCA decisions on this issue and I still can't say with 100% accuracy whether a particular case will be approved or not. The decisions seem to go in different directions and are inconsistent.

You and the company wiill really will need to discuss how to set this all up and the possibilities with the attorney who will handle the filing. All I can say for sure is that it is possibe in some situations. To say more than that would require in-depth review and discussions.
