Hope July cases will start by next month

Let us be optimestic

Since most of July fillers are waiting for long time (more than 3 years min), let us optimestic our approvels will start by march 1st week.
 
How july filers wait almost 3 years? What years of waiting you guys are talking? Explain please.

Hi Habib,

EB3 became current on July01 . Most of the fillers during july 01 are EB3 having their PD minimum 3 years old. If you EB2 my statment will not applicable.
 
NTR is right. EB3 is more then double compare to EB2 in Jul & Aug.

PD issue...Confused

I am confused. Why did people with PD\'s 3 years old wait until July to file their case? One doesn\'t have to wait until PD becomes current! One can file their 485 app as long as there is a visa number for their PD. For example, lets consider a person who started the GC processing (the labor stage) in March 1997. By the time the person completed the 140 stage, if the PD at VSC stood at, say March 1998, they can merrily go ahead and file the 485. Unless I am terribly wrong, I think this is how the system works.
Also, for those who have concerns about filing a few days before the PDs became current, you may want to check where it stood in the month that you filed and compare that with your own PD.
If my above assumption/theory is right, you can find out if you are in a soup or not (hopefully, not!)
Pls correct me if I\'m wrong, guys (and gals)!

You are correct . But look at my case , my PD was 06/98 and it was
current only in may 2001 . I had to wait till it became current .
With the paperwork and lawyer review i applied in july .

I don\'t know what you are talking about, but I know one thing is wrong. We have to wait till our PD being current to file 485, otherwise INS will definetely screw us

Wheresmahgreen looks like totally ignorant of the PD and 485 filing requirements concepts.

To his/her enlightment: Your PD which is set during your labor/140 process, needs be EARLIER than the visa bulletin\'s date for that specific category for that specific month (starting 1st of next month, not the bulletin date) , then ONLY you can apply 485, OR else your application gets rejected (even if it reaches a day earlier than the PD set for your category)

And also it is totally wrong that all the people who filed in July 01, had waited 3 years long. Just one question will clear it off......look at the EB3 guys whose 140 approved just before PD became current in July 01 (say 140 approval came in June 01). They could happily file the 485 the very next month (i.e July 01). With EB3 RIR, the whole process migght have taken just One year. So it makes them as EB3 guys, that waited for just one year from the begining of GC process to apply for 485. NOT as 3 yr waiting time.

One can file their 485 app as long as there is a visa number for their PD " ------- Unfortunately no visa nos are available for a PD of 1998(EB3) till June end of 2000 - I dont think it is exactly 3 years of waiting but more than 2 yrs . Now INS had many visas available and also unused quota of visas transfered to those countries who need them more(India, China...) , hence there is no need of checking the PD and visa bulletins ...else every month between 13 to 15 th we used to wait to check Visa bulletin for PDs..
 
Because, some of us do not need to wait for current PD, whom from countries other then INDIA and CHI
