"HOLD" is on AP

Hi Guys,

Need advise from you.... my case details are:

Second AP & EAD RD.....10/01/2005 (previous AP & EAD are expired on 09/20/2005).....EAD Approved on - 12/01/2005......but AP is in pending....

I did the following things to get a status on pending AP since I've to go my country....

3 times went to the Loacl dist office to request them for Emrgency AP... they said to fax expedite request to Nebraska SC...

I faxed three times Expedite Request with emergency Dr certificate (relative has some medical emergency situation).

Called three times 1800...and put enquiry on pending AP application.

Finally Contacted local senator's office and they informed me that my application is in "Security Check" and they don't know how long it would take or any further details....

today I went to local dist office with Infopass, window officer somewhat convinced and sent us inside, but Immi officer said my case is on "HOLD" . In this situation, local office can not provide any emergency travel document unless until Nebraska SC releases "HOLD" on my application....

what should I do ? I knew "Security check" may take several years and shouldn't leave the country until "Security check" cleared.... hell...

someone might have same situation and plz advise what to do !

BTW.... I-140, first EAD, first AP approved 20 months back....My company record is very good with Immigartion (specified specially since you may have question reg my company).

I am a filer from TSC and my case has been screwed by the Service Center at each step. You can check my signature to get an idea of the nightmare. Anyway last year my lawyer applied for mine and my wifes 2nd AP in January 05. Four months went by and I did not hear back from TSC. I called them several times and each time I got a different answer. One of the answers was that our AP cases had been "administratively closed". There was no explaination as to what that meant. It all depended on the officer. My lawyer also made some inquiries through her liasion in AILA and she got an email that stated that my case is pending "security check". This was the reason given for the delay in the AP. I questioned my lawyer about this because as far as I know, a security check should not delay EADs and APs. My lawyer did not address my question. Finally after 7 months had passed, I and my wife started calling the TSC on a weekly basis and during one of these phone calls my wife was able to get through to a very nice office who looked into the case while my wife was on hold. What she told us was that the officer that our cases had been assigned to has left the department and he closed out our applications without approving them. The officer assured my wife that she would talk to the supervisor about this. A week after this phone call, I got a hand written letter from a supervisor at TSC stating that they had lost our AP applications and that we should send them again without the fees. We did that and within 2 weeks we got our APs approved.

The bottom line is that you should not believe all the "security check" pending updates regarding APs and EADs. You need to keep inquiring and eventually they will approve it.

Thanks for the info. Infact my AP and EADs have been with USCIS since 02/05!! Despite our repeated enquiries thru congress persons, liaision etc. we got the info that our cases are stucked in Security checks (IBIS). Perhaps, based on your experience, it looks as if our applications must have been lost too!!

The problem is when we called 1800...finally it is going to one of the representative (I believe, he/she is not an Immigration officer)..and he coudn't give us more information (same message what we get in site).....also we need to wait 30 days to call them again....

How to talk to an Immigration officer ? I'm planning to contact senator's office twice a week.... they understood what my problem is, but don't know how extend they can help us in this situation.....

I appreciate your response, atleast we came to know some one has gone thru the same kind of pain....
