need advice,
won a green card as couple...our case is current in August......am just afraid because I went recently for medical check up and I was found positive but my husband negative.Although we were married in the year 2007 in the attorney chambers of Kenya and we have a marriage certificate...am afraid if we are going to be given a visa coz of my status....even though my husband is the main applicant and am the beneficiary and the result of my husband is negative.I don't know if they are going to prove our marriage as bonefide since we don't have a kid yet..the only evidence we have is marriage certificate and few photos taken at the office of the attorney chambers when we were being issued the certificate of marriage.....
please anybody with evidence of such case advice.

I remember reading that since January 2010 the ban on immigration for HIV+ persons has been lifted and persons are no longer required to take the HIV test as part of their medical workup for immigration. In other words your HIV status should not even be known to them unless you talk about it.
I do not see a problem with your evidence of marriage, it has been 3 years and you have a marriage certificate to prove this and of course not everyone chooses the big white wedding.

I learnt that the has been some amendments to the law pertaining HIV earlier this yr by Obama. I don't think it should be a problem. Have u been tested positive before u had the last DV interview? If yes I doubt if that wasn't the actual reason of the denial then. I know then it was difficult to travel to the states if someone is positive. U guyz should be fine. Best of luck
