We are a California, USA based company and want to hire an employee who lives in TOronto (Canadian Citizen). We do not have any office in Canada and would hire this person as a full time H1B employee. However this employee wants to split his time between our California Office and his home in Toronto since his wife is studying there. What are the legal implications for such a decision? What if he works out of his come in Canada for 3 weeks/month and works onsite in California for 1 week/month? Can we still treat him as a full-time H1B employee?
