Hi Folks,

I am a new member to this forum....I guess this is the most informative site for anybody who is looking for anything on getting his GC... I am also looking for some info..

Here is my case :wac-02-077-5****
Centre : CSC

I am single guy who filed for his 485 in Dec end. I got my receipt on Jan 4th from INS that they have got the documents. My FP was due on May 10th which I got postponed as I thought I would get some more time or rather delay in the Gc process. This would give me time to for searching for the right girl. I am aware that once I get the Gc I cant bring her and she will have to wait for 5 yrs in India... This law sucks guy :( !!! I went to India for a month during that period but somehow things didndt work out for me..

Now I have given my FP on Aug 16th in San Jose. I know after FP I dont have much time...

What I wanted to know from people in the forum is.....

How much time do I have now to rush to India & get married ?
I am planning to go on Sept 1st and look for a girl again. My only fear is that I hope this 485 doenst get approve fast before I can plan to marry. I have come to know from people that it usually takes 3 mths after FP date...But in my case FP was May.....Did delaying of my FP delayed my 485 or not as I need atleast 2-3 mths to marry. Some people say FP is a independent process and doenst really affect dealying your 485 process..

I also plan to try to go for a "follow to join" as I know in short time I cant marry somebody. does anybody has any exp of follow to join where they could bring their wifes without any problem..anybody had my type of situation...:(
Guys pls help...

Is there an alternate way for anything else in my situation..Infact I am wishing if I can get an RFE..:)..I know sounds stupid but will atleast give me time to visit India, look for a girl and marryy...

Give me some input guys....

I think I am right in saying that there are many people on this board who went thru the same thing as you are doing now. How far they went is another question. GC is very important for the future. But not as important as marriage, not even close.

My suggestion is to let the aos take its course and concentrate on your search. Take a month or two if necessary. There is no dearth of good women in India. You are bound to get lucky sooner than later.

I think you are atleast 2 months away from your approval
,unless u really get unlucky(as in ur case), and it shows up tomorrow....
and take ur time to find the rite girl, I dont think u should rush,
if nuthing works out for u in India, there is no dearth of white girls..:D

Marriage is more important

choosing the right life partner is more important, so concentrate on that.

Dont compromise on your search.

As per the current processing time, you might have another couple of months before your turn (but again anything can happen).

Also, in worst case scenarios, you can bring her on H1 if she is a sw professional or a (para)medical. Or , at least on visitor's visa periodically.

But whatever it is, choosing the righ girl is obviously more important than anything else, so do it diligently. And, if God helped you reach so far, I am sure he will show you a way further down the road also.

Thanks for advise guys...what I am thinking is that i will probably try for follow to join. I guess for that I need to be married before my 485 approval. What I am not sure is whether i need to file 'Follow to join' after my 485 comes or before...
My WAC is 02-77 in CSC I dont know how much time it will take.........

Don't be get tensed....Coooooooooooooooool :cool: :cool: :cool: & Reeeeeeeelax....;);););)

There are lot of important things in life than GC. (Especially when you are selecting a life partner :D :D :D)......As previously said, you can always bring your wife on H1B visa. Well, if this doesn't apply to you, then you can postphone your GC stamping until you get married.

FYI: One of my friend he applied for GC & later he got married.....In his case, he had H1B visa & went to india with H1B & got H4 Visa for his wife (few years). Then he returned back to US. After returning from INDIA, within three weeks he got his approval & got stamped.....

There are many ways out there to solve H4 problems after bringing your future wife.....

Don't worry too much & take your own time to find a girl & plan accordingly. Everything will workout great.

Discuss with your lawyer the possiblity of withdrawing your 485 and re-applying later. I'm sure you would lose some time but far better than losing your life 'cause of a hasty marriage.

Some one here earlier said you could bring your wife on a visitor visa. I don't think that's possible while her GC processing is going on. She could come here on H1 or F1.

I appreciate your responses...I know marriage is more important decison that GC.. I am going in Sept 1st week knowing well that there is no girl there but my parents are looking and everybody is saying its better to be in India than here in US since time is short...

I have given my FP so I dont know if I can still withdraw my 485 or not.. I guess the Labour & 140 is owned by the company so that will remain alive.. i dont know if I abandon the case INS will accept another 485 filing or not once i marry..

Secondly lets say I get approval next month and I get married to sombody who is neither H1 or F1...then obviously my wife cant sit in India while i am in US. In that case if i surrender my GC can I still work on my H1.. My H1 expries on Oct 1st but company has filed for an extension. If I surrender my Gc can I work on H1 again & bring her on H4... I know guys this whole story sucks but I dont know :( what do do or think about...

Somebody was also mentioning that even after 485 approval comes I can still bring her on H4 before I get my Gc stamped.. I dont know how its possible as I am sure all the INS computers must be getting updated as soon as INS approves 485....

Any suggestions guys......pls help if u have gone thru this or know somebody

1. You've delayed your FP, so there is potential chance that your approval will be also delayed (but, with INS I wouldn't count on that!).
2. If you marry before your AOS is approved and was able to bring your spouse to the US (before approval), you can add your spouse to your I-485 application and she don't have to leave the US.
3. If you were able to marry before your AOS and unable to bring your wife to the US before AOS approval, she can wait at her native country and you can file for consular processing (typically it takes between 8-12 months).
4. If you marry after your AOS is approved, its a whole different ball game (H1, F-1, GC girl, Citizen girl etc...).
5. Analyze the situation and ask what you want and work towards your priority.
