Hi,
I came to US on H4 in 2006 and had my visa till nov2007 with I94 till dec12th 2007. I had filed for my H1 thru employerA from a different state and got my status approved in sep2007.
My employer has not sent me the orginals of I-797 or I-94 till date and denies in sending me them as am not employed yet.
1) Now,as my fiorginal I-94 status expires in couple of days I dont have any identification proof in as my state id or DL also,as the DMV office is asking for orginals from employer.
2) Am i legal to stay here in US and if so whats my proof?
3) As my employer has not sent me the documents I dont even have SSN,what should I do?
4) If my transfer my status back to H4 will my H1 be cancelled? If yes, then can i apply in future in a fresh quota.
5) If i need to change back to H4 do i need to have any other docs?
Pls help as am in desperate need of help...
