Hi, guys: Urgent help for 140 denial.

Hi, Folks,

I received eb-1a denial notice email from NSC yesterday after RFE. I am still so sick now. Can anybody give me advice or idea what I should do now, appeal or reapply?
My background is as follows:
1. PhD from China, Now postdoc in one of top univer
2. 19 papers. Some of coauthored papers are published on the top journal of my field, IF>14; two coauthored books in Chinese.
3. Total citation +170
4. Review: 6 times invited from two journal associate editors, >10 times from my PI.
5. Provincial awards and Council member of a Chinese assiocaiton
6. Several reports about my work or paper but no my name.
I prepared the initial application follow a friend's suggestion, but I totally didn't do well, claimed all the criteria, sent to NSC. After I received RFE, I hired a laywer to deal with, but still got denial.

Do you guys think I have any opportunity to appeal or reapply? Any comments and advice will be really and really appreciated. Thank you.:mad:
 
The RFE negatively responded every criteria I claimed, the petition letter was prepared in rush.

Obviously that was the reason. The way you market yourself and present your case is more important than what you have achieved!
 
Can you post your RFE and your response?

Typically you can ask for an adjucation but I have seen very little success from those who have gone that route (both personally as well as from following this forum for the last five years).

Sorry to hear about your EB1-EA denial. My guess is that the denial was basically due to the application not being prepared well enough. Based on your qualifications, it seems that you should have a reasonable chance of success if you re-apply after preparing a new application more carefully. The one area where your case seems a little weak is "having been the judge of the work of others". You do have 6 refereeing requests from journal editors, but that seems a little thin. It might make sense to wait a little while until you get more journal refereeing requests and maybe some grant refereeing requests as well. Your citation record seems good, but it does need to be well documented the next time around, especially for citations in no-English language publications.

Overall, I think that re-applying a few months from now is a much better idea than trying to appeal the denial of your current I-140.
