Well we received the RFE today.....
Although my wife works at an elementary school she falls under health care workers (speech pathologist).
They have asked for certification from the Commission on Registered Nurses, as well as her current licence and employment letter.

I understand that the foreign RN thing is a bit of a mess; but my wife received her Masters here in the US over 12 years ago. The LC also only called for Masters and no experience.

I am thinking we will be OK if we submit her US degree and transcripts, along with the other information that they have requested.

I haven't used a lawyer yet; but wonder if now would be a good time for a consultation....
 
Normal Health care workers, such as nurse, pharmacist, need licenses to work.

I am not sure if speech pathologist needs license. Since your wife is working already, I guess no license is needed. Differenet states have different policies. Ken, I think you need to check with the NC State related Board. Your wife can also aks her colleagues on this matter. If no license is needed for speech pathologist, you may just submit the related documents to explain that.

If not very convinced, please use an experienced attorney.

She does have a speech licence for North Carolina, as well as her licence from the Department of Education saying she can teach in North Carolina.

I was more worried about the Foreign Credential part. If she provides her US Masters Degree in Speech, that should be enough shouldn't it? I mean that is all the LC asked for in terms of requirements. There's 12 weeks to respond, so I want to do it right.

Teaching is going well for me. I am enjoying the career change.
 
Here's the wording....

INS has established interim procedures for certain health care workers in order to ensure nurses...etc....(includes speech pathologists) have education, English language proficiency, experience and training which are equivalent to a US worker in a similar position.... Please read the instructions and comply with those items indicated:

1 current letter (no problem)

2 If you are a SPEECH PATHOLOGIST please submit a copy of your Commission on Graduates of Foreign Nursing Schools (CGFNS) issued after March 19, 2001.

3 Please submit a copy of your current State Licence (no problem)


I don't understand #2. Why? She was educated in US.
It seems to me I sent a copy of her degree with the 485 already; but perhaps I didn't.


All the LC asked for was a Masters Degree in speech.
Prior to the 2 years here, she worked in Canada for 10 years in the field.



this is the first time in the process that I've actually been concerned.....

Found it

Even though she was educated in the US, these new interim procedures still require her to get a credential evaluation.

Can you believe that?????????


Anyway, starting to put the info (and $) together for that.

INS never ceases to amaze me.

On the LC, we should have had them put speech teacher instead of pathologist
