Here's my situation

Here's my situation. I immigrated to the US from Brazil at the age of 1. At that time my father (Brazilian citizen) ran an import and export company out of NYC which for reasons he never told me collapsed with millions of dollars down the hole. What little money my mother had she used to immigrate to the US in 1988 (a little after my father’s business collapse and my birth). We've been here ever since... My mother's retirement in Brazil is coming up (she's turning 60 august of 2007) which means she's going back to southern Brazil. She realized a few years back that having been brought here at the age of 1 I'm fundamentally American though just born outside. So last year in June she married this guy so both she and I can receive a Permanent Residency Card(she doesn’t care about her card only mine). We just mailed out the I-485 and I-130 at the end of last august. I realize that an interview will inevitably come up. So I will have them see each other every weekend starting next week so they're not completely in the dark about each other. I'm just worried that this might not be enough... I know this is illegal but my mother feels horrible about raising me in a "foreign country" and then dump me here after she's done. It was originally my idea to get married when I was 17 but she didn't want to "tarnish my future with a marriage". So I'm wondering, what are my chances?
 
just wondering since you were brought here when you were only 1, did you maintain legal status? if not you are currently an illegal immigrant. you said that your mom applied for permenant residence from the guy she married who i guess is a citizen. you fall under the 2A catagory for your GC and you mailed in the I-130 this august it will take about 2 or 3 years your priority will become current. with the interview make sure your mom and your mom's husband to have some bills under the same name and address like gas and electric, cable, etc. have them take some pics together to make sure it looks as if they are really together. and you mentioned you filed for the I-485, if i was informed correctly you need to have legal status to apply for AOS. best of luck to you and i'm also in the similar situation as you, i was brought here as a child and im waiting for my priority date to become current. take care.

Woa, woa? 2-3 years? I thought this was going to take months. That's what our consultant said.

well since your mom married a US citizen there is still a wait time. i highly doubt that they will take only a few months. if you have it hand, the I-130 petition, do you see a priority date? because of so many people marrying US citizens the process is a lot slower then it once was. now the priority date that you have on the approved I-130 form will indicate the just about how long it will take you to recieve a legal status here in America. since your mom married the US citizen like i said before you fall under the 2A catagory for the spouse and children. http://www.us-immigration.com/news/visabulletin.html check that website out monthly to see where you are for your priority date. ususally it taked 2-3 months for the i-485 to be approved. i never heard someone being a legal US resident in 2-3 months for marrying a US citizen. sorry but im afraid your consultant told you the wrong news. best of luck.
 
Well the Boston disctric the I-485 says december 04 2004 is being processed. The vermont service center says the I-130 for Spouse and Child under 21 is July 16 2005. We sent these out at the end of august in 2005 so I'ts coming soon. I don't understand why it's going to take 2-3 years of all of these processing times are within 6 months? We put in hte application that I was his step-son and of course my mom as his wife. So what's the big deal? And to be honest I can wait for my GC for 2-3 years. As long as I get my work permit and driver's licesnse I'm all set. That wait I get some private loans/scholarships for college and the rest I'll work off.

"A copy of civil marriage certificate showing the names of both parents, or proof that a parent/child relationship exists or existed (if you are petitioning for a stepchild, your marriage to the child’s parent must take place before the stepchild’s 18th birthday)"

That's what the consular asked for. They were married when I just turned 17
 
i didnt realize you fell under the immediate family based information so i apologize for the misunderstanding. so i guess your process is within only a few months of completion. i was just wondering though, the link you posted before was to bring a step child in from another country, your stepfather is sponsoring you to have permenant residency but you are already here in America, and also an illegal immigrant. do you know if thats gonna affect you at all?
 
even if your stepfather adopted you to make it an offical relationship between you it says "A certified copy of the adoption decree (the adoption must have taken place before the child reached the age of 16, with only one exception: if you adopted the child’s sibling who had not yet reached age 16, the older sibling must have been adopted before reaching the age of 18)" but i doubt it will be an adoption issue because you would just fall under a minor with a stepfather that is a US citizen. but once it again it comes to the fact it is all based on bringing a child in from another country. you were already here and didnt maintain a legal status.

well if worse comes to worse I could "say" I'm still in brazil, and just take a plane get a visa and come back. But I doubt that would happen. Because think about it. The US has no record of me being here except school. To them I'm practicly still in brazil. Plus we had to pay a fine for being here illegally. It was paid for and done with. SO I don't think it will be an issue.
