Folks,
Here's an interesting case - I would like to know if anybody else is in a similar position.
Case applied at VSC - EB3 Category
Applied for I-140 = 07/10/2002
Applied for I-485/AP/EAD = 09/15/2002
RD for I-485/AP/EAD = 10/12/2002
AP - Not yet approved
EAD - Not yet approved
I-140 - Approved on 02/28/2003
In the meantime, I have moved to India temporarily to work on an offshore project. My H-1B visa will expire on 08/20/2003
Now, my question is:
1) I am likely to return to US after completing my offshore assignment on or around December 2003. In this case, my H-1B visa would have expired. Assuming that I will get my AP approved by then, would there be any problems at the POE. On the other hand, what if my AP is still not approved at the time? Any ideas?
2) It has been past 90 days since I applied for EAD. Now that I am currently in India, I have no means of applying for Interim EAD. Any ideas of what could be the reason for the delay in EAD? I've heard of several cases that have had their EAD's approved within weeks!
3) The company that has sponsored for my GC is completely behind me. I have all current employment documents/paystubs etc. and as and when I return to the US, I've been assured that all required documents would be provided. However, my question is, at the POE, would I be considered as having stayed out of the country for too long and thereby abandoning my GC appln.?
Anyone with any info. on the above, please comment.
