After reading all the posts, I called him up again.

He said,

According to the press release and conference call of Feb 2005, NSC will identify "adjustable" cases within this fiscal year and send out requests. They promised to judge in April when negotiating a settlement that they had allocated "sufficient" resources to adjust enough applications. He is very firm that I should expect to have my GC by the end of Sep. He did say that some of his client received their RFI today and some haven't received it (although emails told him "we mailed out on June 24."). There will be some time gaps. But, he could not explain to me or even tell me whether all the applicants with RD earlier than Apil 2002 got their RFI or not.
 
The settlement was signed on January 31, 2005. And presented to the Judge June 15th, 2005. Where did april come from through your lawyer?

As I said, per my attorney, anyone who receive RFI should consider him/her case "adjustable" by the end of fiscal year.

To answer your question, there was a conference call between NSC and immigration lawyers so that they can clarify some of attorney's concerns, including backlog of processing RTD, class action settlement. My attorney told me they clearly indicated to him that INS tries gather info for those cases which are deemed to be "adjustable" by the end of 2005.

FYI, the aim of processing RTD will be three months, per INS.

Disclaimer: INS is BCIS. Sorry for my typing habbit.
 
Did I forget to tell you guys that my attorney said it takes at most 3 months from the bio time to get GC. He was very firm about that; he told me during his whole damn career, he hasn't seen any exceptions on that.

Hi windywd, thank you so much for sharing your lawyer's advice. I certainly hope his words hold true in all our cases. Just want to be 100% clear on what you said, does "the bio time" you mentioned mean the biometrics or the biographic info G-325A? Thanks.
 
Here he referred is biographic--G325a.

Based on what he said, usually, when governement asks you to take fingerprints, it is a good sign that your case is moving. However, recently the waiting time between the biometrics (fingerprinting, hand geometry or facial study) and the actual approval can take as long as one year.

For asylee adjustment, past experience indicates very quick approval after all the biographic stuff is received. It does take longer now, but he said roughly your approval timeframe is:

one year after biometics (not applicable for repeated ones, actually he told me it is NOT a good sign if you've done too many biometics. The only "good" reason is FBI rejected it.)
or one to three month after biographic.

To most people, the two are very close.

We'll see.

I share the excitement, but we should not fully rely on what our attorney throw. Not all attorneys are up-to-date. In fact, I sometimes get the most up-to-date info on this forum than from my attorney or other resources. I would suggest, others also check with their attorneys and let us know their findings. Also, it may be good idea we start tracking the bio date and the approval date. We could study the trend that way. Whow will take the lead on this assignment? Any pro on data analysis and forcasting?

Please, read the thread "impact of settlement, on I-485 USCIS Asylee LPR backlog. We can't do forecasting, it would be waste of time and simply add pain to misery.

Don't get too concerned on this. One day you guys will find GC in the mailbox and I believe the time is pretty soon.

I still haven't lost faith on this process after 3.5 years waiting. I still remember the lead attorney whom my lawyer worked for addressed Senate Judiciary Committee in April 2001: "America is a great country. It is destined to be greater when we take care of the most vulnerable. We should feel honored to assist refugees and asylees because our help means a lot to them."

Just wrap up things ASAP and wait.
 
3.5 years of waiting hasn't made you lose your faith - Does this mean anything?

I have been waiting for this damned small green piece since 03/1993 when I filed my asylum application.

Still have faith in this greatest democratic and free country? - oh yeah, still have little. :( :mad: :( :mad:

Did your attorney tell you that there was a conf. call between NSC and immigration lawyers? And then during this conf. call, USCIS said they would try to issue RTD within 3 months of processing?

That would be a little improvement, I suppose. Did he mention when that will take place?

To be exact, one attorney asked INS whether RTD processing is among the backlog elimination (or reduction) projects. INS said "yup, we aim at September to reduce the processing of RTD within 3 months."

They talked about various things. I don't know whether I could find a transcript or not. I wil try tonight.

Could you do us a favor? Please, post your attorney's name and number for "Self Proclaimed Moderator, Exiled Prime Minister and Immigration Expert, Jack of All Master of None Mr.Wantmygcnow"

This man is full of it, if he is so curious about the developments between Attorney's Judge and the USCIS, he should spend some $$$ as a consultation fee and get the desired information.

As soon as we got news about RFI-RFE request, "Wantmygcnow's propaganda mechanism" kicked in, making a tense situation worst. Wantmygcnow, if you can't put up with the situation, keep your mouth shut and stop dishing out misleading information, you pessimist psychopath.

I think wantmygcnow has provided a lot of useful information/suggestions to other people on various issues in this forum. I believe many people, including myself, don't want him to shut up. Everybody is entitled to his opnion. He's a cautious person. You don't have to agree with him, but please respect his rights of expressing his opinions. In the past, I've seen other people disagreed with wantmygcnow on some issues, but they sticked with the issues; they didn't pick up on him personally or asked him to shut up. I think that's the right way to handle conflict opinions in this forum. After all, people do differ in their personalities and thinkings. Please do not drive away other people just because they don't agree with you on some issues.

Do you know what "HOAX" is? His comments are morbid, he can lash his tongue and work his fingers all day long and you can defend him too.

There is a significant difference between being "Cautious and being Ridiculous". His past suggestions does not entitle him the liberty, to add agony to what numerous readers are faced with at present.

If he is so cautious, he should have used a better word than "HOAX". The readers of this forum belong to different walk of life, all are not necessarily asylee(s).
