Please help me with this question. This is for a friend of mine. He is a US citizen married to a H1B holder. Here is the chain of events
1) My friend got married in India 2 years back, he was a Green Card Holder that time.
2) He came back to US and his wife got a H1B and came to US on H1B.
3) They got married again in US legally after she came to US.
4) She never worked on H1B. Although her I94 is still valid and so is her visa stamp.
4) My friend got his Citizen ship last year and applied for change of status, filed I-485 for her and also got EAD/ AP for her.
Now they want to travel to India, can she come back on her AP or there will be problem at port of entry as she never worked on her H1B.
Please share your thoughts on this.
