I Lived in USA for 2 years and now moved to canada as Permanent resident. My F1 visa was denied and his F2 visa also denied .. consular stamped us 214b intend to stay in US.
My husband has received first H1 approved .
1. Does he has to go to India to get H1b visa as it is his First H1b visa. please note he is also Permanent Resident.


2. How many times one can apply for visa. If its denied .

You should have received a paper form the consular official as to why they denied your visa. You should be able to enter the US on H-4. Does your husband have Canadian PR status? If so he can apply for H-1B visa stamp in Canada. If he dosen't have Canadian PR status and his visa is denied in Canada, he will have to travel to India from Canada to get the Visa stamp. You can apply for H-4 when he applies for his H-1B visa.
