Here are my questions:
1.I lost my receipt notice for I-485. I don\'t have any photocopy. What should I do? Someone said I would never get the replacement receipt notice from INS if I simply write to them to ask for it. So what would be a better way to help me out?
2.Currently, I didn\'t get any info from INS after I filed my I-485 on 12/21/2000. How can I get info on my pending I-485? If there is no quota for me to be adjusted to PR, what should I do with it? To file another I-485?
3.I want to leave USA for an emergency travel. Is there any same-day AP processing at INS New York Local office? If so, what kind of document should I bring with me? Since I already lost the receipt, what should I do to prove my current legal status in USA?
4.Can I ask a lawyer to find my info on my I-485 with the INS local office? Can the lawyer find out whether my pending I-485 is hopeful or not? If I have to face the denial of my application, what should I do next?
Can I ask the INS to return to my F-1 visa? I\'m currently a student.

Your assistance is highly appreciated!!!!!!!!!!

Your lawyer is the key

You lawyer should have copies of all correspondance and notices so please before sounding all desperate about losing your I-485 get a copy from the lawyer.

> Can I ask the INS to return to my F-1 visa? I\'m currently a student.

If you are a student how do you have a filed/pending I-485? If you have changed status from H1 to F1 you have cannot apply for GC and become a PR.

Make sure as a student you are eligible to apply for and have AP

evidence of filing I-485 by FOIA request

you may acquire evidence of the filing of I-485 by submitting a Freedom of Information Act Request for either copies of your file or for information on your status. form is available online at www.ins.usdoj.gov.

If you have moved since filing, send a notice of address change to the office where you filed the I-485. If the application has already been processed and denied, you may be out of luck.

If a visa quota is necessary for your GC, the interview should be scheduled after a visa is available.

If the application is still pending, you may submit I-131 with fee to local office for advance parole. Most likely, INS will let you leave, returning without advance parole will be a problem. documents willneed to include your receipt notice (or the evidence obtained by FOIA), your passport and/or other picture ID.

Of course, you can always hire an immigration attorney.

If your student F-1 visa is still valid, you may function under the dictates of that program. However, You might lose the I-485 if you travel without the AP.

If your student F-1 visa has expired, and if your I-485 has already been denied because you missed the interview, you are out of status and need an attorney.
