Hi, My lawyer will file 485 for me soon. Also my business sector will be sold to another company in th next a few months. Is there any way that I can keep my current GC process instead of starting over again? Thanks. Min
 
Don't worry...you can still keep your GC process going....

Depending on the merger type, you'll have to file an amendment to I140 if it happens with in 180 days after filing your 485......But if it happens after 180 days I guess AC21 kicks in and you don't need an amended I140 as long as you stay in a similar job position......but AC21 is still at the interpretation level and INS has not released any regulations on it.....hopefully they come out with regulations by the time you make use of it....

I-140 Amendment

I-140 is employer specific and the employers give details directly to the lawyer. You are normally not allowed to get that info. So it is best to leave it to the lawyer.

I-140 Amendment

To make it simple, I-140 Amendment includes the similar 140 application but with the reference of the older one which was approved, and with the information of the new co. name, Tax ID, etc. It will also have an explanantion that the new co. is successor in interest (means the new co. takes over all the legal repsonsibilities of the old co. and would support the previous application for 140.) Again, the lawyer will put it this in a proper form and in legal language.
