my husband received the letter today may,19. he is in our country and i am here in the u.s.a
i am overstay with my visa witch i mean i am illegal right now. my question is:
should i go to my country to get the visa with him?
will i have any problem coming back to u.s.a after i received the visa??

well overstay WILL BE a problem!
you should go back to your country asap and try for the visa together with your husband.
No one guaranties you will get it after the overstay but may worth a try! This situation may cost your husband's visa too! Try and contact your country's US embassy and ask them about it. They may be kind! But overstay is a SERIOUS REASON of visa denial!

How much did you overstay ? ist less than 6 Month? less than 1 yaer? or more?
 
I hope you have a good explanation that you can give to the U.S Consulate/Embassy why you overstayed.

I mentioned this in the forum before, even if you pass the Consulate interview and they give you the visa, you still have to go through the POE. When the POE officer found out that you had broke the law by stayed illegally in the U.S, there's a possibility that the POE officer will denied your entry to the U.S and possibly force you to go back to the home country.

Visa is not a guarantee entree to the U.S. It is only after you pass the security clearance by the POE that you are guarantee entry to the U.S.

It's not that easy if someone comes with a immigrant visa.

Even if she managed it to get out of the country, the next step is that she has to make wrong statements in DS-230 where she lived the last years.

For amnesty? I'm sure, once they find out you are in the country they will deport your.
 
can my husband go to the inteview without me ?? (i applied for him from here and the status wa married at the application)
what if you will say that we are sapered?

my question is kinda similar. I know someone who got selected for further processing for DV-lottery but her visa expires in September 2009. She is in the US on an F-1 visa getting her Masters, anticipated graduation May 2010.

By the time she gets called for her interview it would be July 2010 comparing her case number with this year. She is scared to go renew her visa before the interview because of non- immigration intent on F-1 visa. She would still remain in valid F-1 status by then (F-1 OPT) but her student visa would be expired.

Would that affect her interview next year?. Since her case number is kinda high, AOS is not advisable. What do you think? Would she be considered illegal in the US since her visa has expired or remaining in F-1 status is good enough

Also, is there anything to be scared of, should she just go ahead and renew her visa in September like she would have if she didn't get selected

All she needs is a valid I-20...it doesn't matter if your visa has already expired...as long as you have a valid I-20 you are good to go.
 
As long as she remains in status based on her I-20 and her I-94 says D/S, she is fine.
It would be tough for her to renew her F1 visa with the lottery once she has informed KCC that she wants to do either AOS or CP.
She has two options:
1)She could just remain in the US, do CP and travel once she has gotten an interview date for the embassy
2)or do AOS (though you said her number is high)

k, thanks axldai and drMBA. She has decided go for cp next year if she gets a 2nd NL. Its a huge risk though, its more like all or nothing since she cant renew her F-1 :(

Hopefully, everything goes well. We would have to wait to see how it goes
