I got 9 applicants for my job advertisement. One of them seems qualify for my job based on my job description (Master degree and one years experience ........). And he has a green card. An telephone interview has been set up between my boss and him on Tuesday. Now I am so worried that my boss could not find an excuse to reject this applicant. And I would like to know What are the reject reasons acceptable to the immigration department..

Please advise. Thank you in advance.

Thanks MKung

Thank you very much for your reply. I am just so worried about the result of the interview.
The applicant has been working in Honolulu, HI, since 04/2005 (only 1 year and a half). His family is living in New York. One of the reason that he applys this job is to live close to his family (about 2 hours driving to New York). Can we say that eventually he wants to move to New York, so he will not work here for long time?
Also can we require the recommendation letter from his current supervisor?

Thank you so much.

Don't know the answers those questions and i will let others respond.

I have seen employers use very subjective reasons to reject potential hires, and my opinion is that you can certainly play this hand. Qualified potential hires have been rejected because the interviewer doesn't have a good feel about him/her, the interviewer doesn't feel that he/she can contribute to a team environment plus a host of other reasonable subjective reasons.

I wouldn't worry too much but if I were you, I would talk to an attorney and the employer in order to come up with a game plan that is consistent with the spirit of the alien labor certification process.

And there is always "lacks communication skills". This certainly applies to green card based potential employees, since there are many out there who do not possess good comm skills but do have permits for employment for one reason or another.

When your boss speaks to him, he'll know.

caution !

You've gotta be EXTREMELY careful here. I keep seeing people in this thread indicating that "subjective" reasons are OK to disqualify a U.S. worker. Remember, "The LC procedure is not intended to locate the most qualified of best candidate for the job" (which may be you). "Any minimally qualified U.S. worker is considered 'available' for the position EVEN if the alient is more qualified or better suited to fill the job."

See attached scanned pages from the LC handbook.
