I quit company A and joined company B in Jan 2001. I was working for company B with H1B applied (not approved yet). I was taking advantage of the new rule(then) and started working for company B. There was an RFE raised on H1B and in the mean time I got laid-off from the company in the month of March 2001. I wanted to change the status to H4. At that point in time my husband was working on F1 (OPT), so his company was slow in applying for H1B. Finally they applied for his H1B (for my husband) and H4 (for me) in last week of May 2001. After I got my H4 approval, I joined school in August 2001 and went to Canada and had my F1 Stamped.
QUESTION: Would my stay between March & May considered illegal? My I94 from Company A was valid till December 2002.
