dear all,

I have a short question regarding my current situation.

I'm a 29 Year old Research Specialist working for UC Davis in California, on a J1 Visa, which will expire on August 31, 2010. My fiance and I are going to get married on the 29th of May and are currently planning not all the wedding stuff, but also trying to get all the paperwork together for the green card application. To say it's a touch stressful, it's an understatement.

Estimate for filling the Greencard application: June 5th, 2010

For this we have some questions.

1.

My country of birth was the DDR (East Germany), which fell apart in 1989 and so I only have my east german birth certificate and was wondering, if I can use this? Or do I have to get an international birth certificate somehow?

2.

My current visa expires at August 31, can I stay in the country once I applied for the greencard? What happens if my current visa expires, while I'm waiting for the new one? For some reason I could not find a real answer for this question and I'm sure countless people asked this before.

3.

Proof of relationship. I read the post about this and it all sounds rather straightforward. But my fiance and I have only been dating for 3 month and met online on eharmony. We have a very happy and very fast moving relationship. Which a lot of people have a hard time understanding. But our friends and families support us and it's very obvious to them that we are deeply in love and made for each other.

At this point we are considering doing this by our self, without a lawyer. Since we just don't really see how we can afford one.

thanks for your help!

thanks for your quick response,

yes she is a USC and I don't have the 2 year HRR. Neither on the DS2019 or on the actual Visa

1. Submit a copy of the certificate you have, along with a certified English translation, but also seek to obtain a reissued one from the current German government so you can provide it for the interview. Of course, if you get the new one before filing the GC application, send the new one instead.

2. You can continue to stay in the US once you've properly filed the I-485. But without employment authorization, you can only study but you can't work. So you'll have to quit your job (at least temporarily) if your J1 expires before you receive employment authorization.
