Help with I-765 Question 9 and 15.

Hi:

I've been in the US for about 19 years. I arrived here with a Visitor Visa and overstayed. I recently married a citizen and we are in the process of introducing all the paperwork at USCIS to adjust my status so I can obtain legal residence.

My question is this, I'm filling the form I-765 Application For Employment Authorization, and in the question number 9 this form asks to write each and every Social Security Number that the person applying might have used in the past.

I did use a Social Security number invented by myself, because I worked all these years when in reality I shouldn't have since I only had a Visitor's Visa, but I had no choice, I had to support myself and in order to obtain employment I had to write down a Social Security number in every job application, and then make all the contributions to it that were deducted automatically from my paycheck.

Should I answer honestly this question, or should I just type N/A?. What could happen if I do answer one or the other?.

My other question refers to question number 15 in the same I-765 application, the question is Current Immigration Status, should I answer VISITOR, OVERSTAY or VISITOR OVERSTAY?.

You should answer these questions as honestly as possible. Any Unauthorized employment and overstay will be forgiven when you AOS. Just make sure you do not leave the country until you get your green card.

Thank you for answering my question, I just need you, please, to elaborate a little bit more on this, will I get in any kind of trouble when submitting these papers to USCIS?. We cannot afford to hire a lawyer, and we need to resolve this matter ASAP, but I want to do things right so the process goes as smooth as possible.

I understand that you want to be honest and the most clear in this application, so make sure you omitt the Social information, just put N/A, because the social that you used was fake so there is not need to put it there, in case you would have a real good social, then you will put that info. in there. They know you work in the past, but do not put that information in there, you might find an examiner who will passed that action, but sometimes that can turn into a headache. There is not need.

Not unless you claimed to be a us citizen on your i-9 forms. Some USCIS adjudicators are illegally using this to give applicants a hard time by denying petitions saying applicants made false claim to american citizenship and are therefore banned from AOS. Just answer the questions honestly as honestly as you remember including the made up social security number.
