Help with I-751 Icky issue

loving spouse

Hi, My husband and I have been married for almost two years now. We have been living in separate households for all but a few of the months due to my husband's work. When we presented for our interview, the adjudicator approved our application on the spot, knowing that we were going to live in separate states due to my husband's new job and my desire to stay where I was at in order to allow my daughter to finish her last year of high school.

A few months before my daughter was due to graduate, i began the job search, started meeting with a real estate person to sell my house. I was having a lot or problems finding employment and my house depreciated in value due to the market and as a result, we would see a loss if we sold it. At the same time, my husband was struggling at his new job and was really wondering if the job was right. At the time my daughter graduated, my husband decided he wanted to come home. So, he has been looking for employment here and planning to come home.

Meanwhile, I suffered a serious financial hardship and am considering filing an individual bankruptcy. My concern is how will this affect our I-751 petition. If I file bankruptcy, the attorney said that they must state that my husband and I are separated and maintaining two households otherwise they will factor my husband's income into the equation and adversely affect my bankruptcy.

My husband and I are very much in love, but really do not share finances and with him living alone, a lot of his income goes towards his living expenses and there's not much left over to send my way.

Since I sponsored him, will this threaten our chance to have our conditions lifted and his green card approved? He is still planning on moving home, but wants to have a job before doing so.

Sorry this is so long. Thanks for your help!
