Help with I-485 for NIW needed

Can anyone let me know which category to check in Part 2 (application type) of the form I-485 for NIW. The obvious answer looks like "a. an immigrant petition giving me an immediately available immigrant visa number has been approved." But i am filing I-485 with my I-140 which is not yet approved.

Second, as per I-485 requirements given on form, letter of employment as proof is needed. "If your adjustment of status application is related to an employment based visa petition (Form I-140), you must submit a letter on the letterhead of the petitioning employer which confirms that the job on which the visa petition is based is still available to you. The letter must also state the salary that will be paid." I am filing I-140 for NIW which is not based on any employment offer. So do i still need to submit the employment letter from current employer?

I am filing I-140 for NIW which is not based on any employment offer. So do i still need to submit the employment letter from current employer?

Execuese my ignorance. I had the same question (applying I-485 AOS concurrently with I-140) but was not clear which option to check in part B?

You can either check "a." or you can select "other" and write "Immigrant petition giving me an immediately available visa number is being filed concurrently". Choose whatever will make you sleep better at night, even though it will make no difference to USCIS... ;0
