Does anybody know what does USCIS send to FBI when they request for the name check for a pending application ? Is there a document out there describing this information ???
My DV-08-based AOS application is pending since December 2007. From USCIS, I got 3 submission dates: January 31st, April 10th and May 16th. [[The people that I talked to when I heard that they send the name check to FBI on April 10th when, initially, I was told about January 31st, said there is no record of January 31st. The person that told me about May 16th didn't seem very sure of himself and said that it might be a re-submission.]]
Because I was not getting any straight answers from USCIS, I wrote to the senator and asked them to try to find out the earliest date when my name check was submitted (so, that I can use this date for the 180 days of pending FBI name check memo). The senator's office didn't talk to USCIS, but with FBI and they got a list of names and dates pending in the NNCP. There are only two names similar, but not identical to mine and the dates these names were received in the program : April, 10th and May 22nd. There is no entry for my exact name. Does anybody know what it means ?
If these are names sent by USCIS, then they didn't send the correct name and it's my belief that it's not their task to submit FBI name checks requests with different name variations, but it's FBI's job as part of a name check request to try variations. Am I right in this ?
If they sent my name at some point, then it should have been done cause it's not in this list of names and they should continue with the processing of my application and not stall by submitting requests for names slightly similar to mine.
