I was working for a government agency on a J-1. At the end of my program, the government agency applied for a waiver for the 2 year home requirement for me. At the same time, a sponsor company applied for an H-1B (but I will still be working for the government agency).
Meanwhile the cap was reached and I was told that the petition for the H-1B was rejected.
Even though the sponsor company applied for my visa, can the waiver based on the IGA (interested government agency) help to obtain the visa based on the fact that I will indeed work for the government (exempt organization), but paid by the sponsor company???
