We have interveiw scheduled for next Tuesday. However, my spouse couldn't find the birth certificate. I have mine with me. I am wondering how critical is that? If IIO ask for it, and we don't have, what will happen? Will this delay only my spouse's application? or both of us? Since time is limited, what can we do now?

Thanks for answer.

Mostly they ask for the copy of Birth Certificates. So give them the copy when they ask for it. Unless they ask for original it should be go fine. If they ask you can tell them that you have misplaced them or some excuse

Thanks for the suggestion. The probelm is that my spouse don't even have photocopy of the birth certificate. I am the primary applicant, I don't think we submit any birth certificate during the whole process so far. What if we don't even have a copy. Will the IIO accept the excuse? There is certainly no time to get a new one now.

I would suggest you have an affidavit executed (if possible by her parents) stating her date of birth and attesting to the fact that they are her parents. You can present this in lieu of a birth certificate.

We filed affidavits and a non availability certificates. You have to make something ready just in case they ask for it. As in the previous posts affidavits can be used saying that you don't have one.

It may solve your problem..

Thanks and Good luck

Thank you all for suggestion.

we went to interview today with a copy of birthcertificate for my spouse. The office didn't ask for it at all. He just asked some routine questions, and later, said our security check is not cleared yet, they will contact us through mail. I am so disappointed.

Is that true? or the office just didn't want to approve our case on the spot? we didn't have any criminal charges, not changed jobs, not moved, what could be wrong, and most of all, will it definitely be an approval letter or the approval is still questionable. how soon we will get the approval letter? I just can't believe this.

Please help me understand the situation, what should I do now other than waiting?

Very good. Atleast you have put one problem behind. Lot of people are like you for name check and me for not having a document at the interview.

I sent the doc later but I have to wait until they approve it after reviewing it

Thanks

do you have an idea how soon they will get the result back to you? can I move or change job at all during this period of time? I have been waiting since first started the process at early 2001. it's tooooooooooooo long.

better sit tight until you see it. I also can't accept too good offers yet. I don't want to disappoint you, but some people are waiting from Aug 2004 after their interview.

No problem

You will recieve your aprroval very very soon -God-willing.If they were to deny you on any other base, they would have told you so at the interview. So your approval is guaranteed providing your name check is clear; ie, you have no criminal recoed. My husband's FP was not cleared at our interview-so he had to get some paper from the police for it and he is going for stamping today.(2 days later after interview)Cheer up -all is well

fam, thanks for the information.

was the immigration officer asked your husband to get some documents through police? can I also do the same? the officer interviewed us didn't ask us to do anything other than waiting. What information your husband get from police? I just don't know how to proceed from this point other than plain waiting. I had my 2nd FP done last June, and my spouse had his done last December. the officer didn't tell us which one's had not cleared yet, and I was too upset to ask him there. I am afraid its just some excuse he used to not give us approval at the spot.

Also, he took both of our I-94 forms originals, is that normal?

coldfusion, will you do anything to speed up the process? contact congressman or apply for another EAD or AP will be helpful for them to dig out your files? I don't want to just sit and wait. I have been waited too long.

Congressman may help. But you may want to wait for 3 to 4 weeks. It may be through with in that time. If not, you can contact congressman.

Thanks

Thank you all for information. pdramesh2000, the link you provided is very informative, Thanks. I have been through I-140 RFE, I485 RFE and transfer. I thought the hardship would come an end at the day of interview. but now it seems just begining of another long journey. Actually, I received a message from FBI last September, saying they never had any request about Name Check from VSC, I didn't take it serious at that time, thought it's just a mistake. Now I will have to make various request to figure out what's really going on between FBI and VSC. I start to doubt if this green card issue really worth for me holding my life for?

Wish you all good luck!
