Hello,
I’m really very glad to find this excellent website! I already find lots of useful information to finish the form 1-129.
Now I have a question that when I should submit the I-539 for my spouse?
According to the I-539 instruction I must submit the application with:
A-- The Form I-129 filed for that employee or a copy of the filing receipt noting that the petition is pending with USCIS;
B--A copy of the employee's Form I-94 or approval notice showing that he or she has already been granted status to the period requested on your application
According to “A”: should I submit I-539 with my I-129 together?
But according to “B”: I must already get a valid TN visa before I submit the I-539 form!
So what should I do then? I want to mail my I-129 to the Service Center.
If I send the I-539 after I get my TN visa, then my wife will be sent back to Canada after her TD visa expires. And I’ll be lonely again!
Oh, faint again. Who can help me?
