I am an F1 student married to USC in Feb. We had our interview today in Baltimore. All went well until we were asked to produce proof of living together. We moved to our new residence in Aug so i have the lease, electric, phone, bank etc (all from August). We filed for the AOS at another residence that we lived in from Mar to Aug. The interviewer asked why we couldn't show proof of life btw Feb and Aug and we said things were up in the air and we only just settled. I told him i could fish out the lease from our former residence and he said - OK. He said that because we got married in Arlington - this looked like other fraudulent cases that have been submitted. We told him that my husband in on parole in a nearby state so we couldn't really do anything until he got the go-ahead from his parole officer. The interviewer told us to wait for a letter. I asked if this was a denial or approval and he refused to give a definite answer. What does this all mean? Should i get a lawyer? Please help!!

It still says the same thing - that it is pending (11/21/06). It doesn't mention anything about interview.

Check again in a few days. The DAO may actually have withheld adjudication, in which case a 2nd interview might be coming.

Try to relax. There have been many instances of immigration fraud recently in VA, particularly Arlington. You are butting heads with official policy, because of some political pressure placed on the government in that region to "get their act together."

At worst, you may be called for an additional interview. Do try to get the documentation for Feb./Mar. if possible.

Hi:

In response to your PM, I meant try to get the evidence in case you get called for the second interview. Unless this happens, or they request something else, do not worry about that. I do not want you to rely on this, but what will most likely happen, is that they will make a decision in a couple of weeks without another interview. What happened to you is more standard than you think.
Try to not worry too much.

Best wishes.

Relax

Bmore,

If the Interviewing officer suspect fraud, and by virtue of having married in Arlington, VA, USCIS has a right to ensure that your marriage is a legitimate one. It could take them a while to figure this out, so for now, relax and collect your evidence. It will be nice and advisable to start collecting all forms of evidence that you have been dating for some time. If you have emails which you guys exchanged while dating, going longer than your current married life, get them out and be ready. ;)

Pianoplayer's suggestion is a good one: prepare yourself for the 2nd interview, if nothing else. The second interview, is going to be hostile one. USCIS is going to seperate you guys, and asks you some tough questions to see if your marriage is fraudalent. Prepare yourself with all evidence which can vindicate your marriage from possible fraud implication by USCIS. Alrington, VA has issues, and I recently posted an article on immigration fraud there, and last week or 2 ago, USCIS office in Fairfax, VA, it was found out that a snr official there has been selling US citizenship to mostly Chinese illegal immigrants for $30,000 per certificate, so anyone who applied for citizenship in VA through the office and is of chinese or asian heritage, there is burden of proof to show their greencard and prove that it was issued legitimately. So, you aren't the only person in this boat.

For now, it will probably take them 60 to 90 days to make a decision. Go on with your life, because there is nothing that you can do, as the ball is in USCIS's court. If they deny your petition, you get a lawyer and reopen the case and win with counsel by your side. All is not lost.... :D
