Hi,
I opted for CP when I filed for my i-140. Now to save some time I sent my entire application mumbai consulate for Attorney certified processing. Soemone told me that I HAVE TO apply i-824 EVEN THOUGH I HAVE APPLIED FOR cp FROM THE VERY BEGINING. i WAS NOT AWARE OF THIS. Can anyone throw some light on this?
Will my case be rejected since i didn't send i-824 recpeit? I thought I-824 is used when u change from AOS TO CP.
Pl. advise! I am really tensed! If that's the case, can u tell me how to apply for I-824 by myself (not with a lawyer)?
Is there a possibility that i fax the i-824 receipt to mumbai and they accept the case?
I seem to be in big soup..
Please help!

Do not panic! Dont worry that the consulate will reject your case. What will probably happen is that they will call it INCOMPLETE )(not reject) due to missing I-824 receipt form. Coz 824 form is used for multiple purposes one of which is to transfer the case to the consulate. And without 824 receipt the consulate does not have the authority to process your application.

NEXT STEP: What I would suggest is that consult with your attorney (I recommend..but upto you), complete I-824 (http://www.immigration.gov/graphics/formsfee/forms/i-824.htm) , pay $140 fees and once you get a receipt include it with your AC I-140 packet and include a cover letter that you had previously mailed AC I-140 packet without I-824 receipt and now that receipt is included.

quick question:
The I-824 application says:
PArt 1 -Information about the person that filed the petition.
After that it has :
1) individual name column (where probably my name will go)
2)Organization name
3) address
4) DOB,SSN etc
My question is: for address ,am I suppose to put my address or company's address. Right after the address column they have DOB,SSN etc column hence I am a bit confused whther i shud provide my address or petitioner address.
I am filing this out myslef and not going via my attorney (and she told that i can fill it for self). Also, the address i put will determine where INS will send the I-824 recipt.

Any help on this will be appreciated!

for reference I-824 form is at
http://www.immigration.gov/graphics/formsfee/forms/files/I-824.pdf

My suggestion is enter your residential address. Ask you attorney before sending in the completed I-824 form!

i have one more question:
Kdivekar,
Yetsreday u told me that my case# will be different thatn what is generated in NVC (BMB...). Mumbai will generate a diff case# for me for MY AC-140 Case. Right?
Today I got an email from Mumbai saying that they ahve not recieved my case yet though i mailed them all the docs on 29th aug which they got via DHL on 2nd dsept. I ahve mailed my original I-140 approval hence I am concerned.
In my email i provided them with my NVC generate case#,my name, petitioner name etc.
Could you pl. tell me how shud i enquire abt my case? Previously I just asked them my status with the case # generated by NVC. Probably they searched that case # and couldn't find it. Shud I wait for one more week and then give them a call and ask them to search by my name, petitoner name etc ?

Normally it takes upto 6 weeks from the time your sent AC I-140 papers or upto 4 weeks from the date your packet was actually delivered by your courier service, for the consulate to acknowledge the receipt of yoru packet. I f you check the date timelines for rohufish you will realize in his case it took about 6 weeks for bbay to acknowledge receipt of his case from the time he had mailed it.

In another friends case , it took only 3 weeks. Since it has been only 3 weeks you may want to wait till mid next week. Also when you follow up you want to give your first and last name as it appears in the packet. And make sure you spell it out. Since this is the only way to search for your case as your bmb number for AC I-140 case is still not created.

eg: Your name is Robert but you go by Bob...make sure the person at the consulate searches for Robert (and not bob) and spell it out for him/ her since one can search Robert as Roberts/ Roberds or anything else which will not pull up the case.

Same happened with me since I have an extra ordinary long first name. My folks in india had bbay search by my name as i go by out here (short form of my first name) and then next day had the same person at the consulate search by my full first name and last name and the record pulled up.
