Help w/ I-130 Q.#22, I-485 part 3 Q.#2

Hello friends,

Back in '99 on a B1/B2 visa I was denied entry and was sent back home from the port of enrty (airport to airport) on the basis that I was not using the right visa and was a public charge (coz' on our last visit my us citizen son, had an accident w/c compelled us to go to emergency). They cacelled my multiple entry visa & wrote 212.(a)(7)(A)(i) & 212.(a)(4) on it, but was never asked to sign any papers. So I'm not sure if that was expedited removal or widthdrawal of application. Making it short I was reissued a B2 visa on 2001 made it back here in the US and was able to change my statust from B2 to F1 and now F1 to H1B1. My son is now in the process of filing I-130, I-485, & etc. So am I to answer yes or no on these questions? Coz in the embassy I was explicitlly told that they did not deported me when they reissued my B2 visa.

I-485 part 3 Q.# 2 Have you received public assistance in the United States from any source, including the United States government or any state, county, city or municipality (other than emergency medical treatment), or are you likely to receive public assistance in the future?

thank you for your response . So I will still answer no even we availled of medical benefit? would'nt that straight forward not telling the truth or in short lie, w/c might eventually give me problem? Again thanks in advance to everyone for reading and for your advice/comments.
 
I'm not sure how to answer your question, but I had a gray situation for one of those questions as well. I ended up answering yes and attached a letter explaining the issue and some supporting documents. I would rather risk being called into an interview to be inquired about the issue than risking the possibility of being rejected for not being truthful.

In your first post you mentioned this medical care was in an emergency situation? If that is the case then you can answer "no" as emergency medical care is exempt. If you however received non-emergency medical care you did not pay for, or somehow got it paid for by someone or some (insurance) company, you are probably better off answering "yes" and provide an explanation.

As long as you have a valid explanation (car accident) and some supporting information (hospital report/police report/hospital bill or something along those lines), you should be fine. It's not like you planned to be in an accident and go to the ER, but those things happen.

Hi Talkingtac... thanks for sharing your experience. Would you mind if I follow your case as it progress. Hopefully you will continue to update your process since I will be filling all my form by end of oct.
