My case is different. I applied for I-140 and I-485 in 11/03/03 thru my previous company A wahen I was in NJ. After 4 months, in 03/04, I moved to some other company B and working at NC. But my EAD approved on 04/01/04 and I-140 approved on 06/16/04. To be at safe side, I have applied for LC and got it approved thru current company B. Now I am in the process of filing I-140 and I-485 thru company B, beacuse my previous employer told me that he has sent withdrawal request for my previous I-140 on 04/01/04. But I didn't use any AC-21 or anything else because 6 months of time was not completed with my previous employer since they filed for I-140 and I-485.
Meanwhile, I have got FP notices based on my previous process of I-485. Now my question is whether my previous employer has sent withdrawal request or not. How can I come to know whether he has sent or not. But he has given a date when he has sent. I have asked him to give me a receipt for it, but he hasn't given me. In case if he has sent, howmany days it takes for INS to complete the process of that I-140 withdrawal request.
Now my questions are given below:
1. Based on my previous I-485 process, should I appear for Finger Printing or not?
2. If I go for FP, will they ask me to show any letters from my previous employer.
3. If I tell that I changed to some other employer, should they ask anything else?
4. OR is it better to ignore that FP notice letter and continue to apply for I-140 and I-485 thru m current company and wait for it?
5. Should I respond for FP notice if I don't want to appear for FP?
6. If I don't want to appear, what is the reason I have to give them in the reply?
I have sent my documentation to my current lawyer, he is preparing the final copy of the papers to file for I-140 and I-485, but still not yet filed.
Please suggest me. If your help will be appreciated.
