Help to return US from Canada

Hi all

I just landed Canada on 02/08. The Canada immigration officer took off the whole lower part of my I797 including I94. Then she stamped a Canada immigration stamp on my passport and stapled the landing paper with the pp. I only keeped the upper part of my I797.

Now my status is I485 pending. I have AP for reentering US, but I don't receive my renewal EAD which has been approved. Cause I plan to return US on this Wednesday, I wonder if there are any problems when I cross the border of US with my pp stamped Canada immigration stamp and the landing paper.

1. Are there any problems that I only have the upper part of my I797?

2. Can I take off the landing paper from my pp to avoid any unnessary questions when I cross POE of US? Is there any problems if the officer knows that I have landed Canada?

3. Which date will be stamped on my new I94? The expired date of AP or I797's?

Why would you even bother to show Canadian immigration offcier your H-1 approval notice i.e. I-797.

Or they specifically asked for it? Why would they want to keep lower portion of your approval notice?

I thought they check Canadian immigration papers not U.S. status stuff? Are you currently working in U.S. Is you H-1 is still valid ?

I don’t think that you are going to have any problems in getting back into U.S since you have AP.

do you have valid h-1b(unexpired visa) stamped in your passport ?If not you may have problem as leaving country while pending AOS means abandoning AOS status.

However, check with your attorney for professional advise as this my personal understanding only. GOOD LUCK.
