Please help, I am very confused and concerned about what to do.
Background info:
- I am an L2 visa holder, recently renewed.
- I have applied for renewal EAD (this is my 3rd renewal of EAD). I have gone for biometrics, and have sent in docs, but do not expect to receive the new EAD card for at least two more weeks. I don't anticipate any problems with approval, everything is in order.
- I was formerly employed by another company, but I left that job on 10/7/05. My old EAD expired on 10/13/05. I was out of the US from 10/9/05 to 10/29/05.
- I am starting a business. I have set up a Connecticut S-Corporation, of which I am the sole shareholder and president. The company was incorporated on 9/22/05.
- The company has not yet received any income (I have not opened a bank account yet either), nor have I received any salary or payments from the company.
- Don't know if if matters, but we filed for adjustment of status to permanent resident several months ago.
Questions:
- I have now read in a few posts that you have to be a 'permanent resident' to have an S-Corp? is that correct? Should I change to an LLC?
- Will this 'gap' in my EAD be a problem?
- If so, what should I do?
Seems a lot of expense and effort to close down the company and then set a new one up in a couple of weeks.. but I don't want to screw up my status.
