Hi,
I have used a labour subst for filing my greencard. Unfortunately it is EB3. With this retrogression don't know when it will be approved. My I-140 was approved a month back.
I have few questions:
1> As it was filed under EB3, JOB did not require that much skills. I am currently working in more managerial and IT architect job. My substiture Part B mentioned clearly what I am doing currently.
Now question is :If I avail ac21, will my part B job substitution used in my current application be compared with Part A of new I-140 application or is it always part A to Part A comparison? How does this work ?
If I jump to new employer in order to keep priority date, do they have to file LC under EB3 category or they can file under EB2? New Job requires skills what I am currently doing. As my 6yrs of H1 period is currently going, what are my options.
2> can I file for Perm when I am waiting for I-485 application and I-140 is approved ? Do I need to withdraw my application? Does it make sense to pursue perm in my case ?
