Hi Seniors...
Need yr help..in this situation..Pls help...

My 6 years on H1 expiring on 1st'July this year. My I140 already approved
on 04/27/2005. I have valid EAD and advance payroll valid till Jan'06.
I want to travel to India in June and will be coming back on 5th of July. Here are my questions.
1)Will it be a problem while coming back if i come back on advance payroll.My company is already applying for 7th year extension.So after coming back ,can i work on H1????
2)What happens ,if my I485 gets approved while i am out of country??
I140/485 concurrent filing in Nov'04(EB2 from NSC)


Pls let me know the risk factors..Thanks a lot in advance.

Advance Parole

I don't see it as a problem as long as you have your Advance parole documents, Original EAD, H1B Papers, Travel Tickets saved both from and To desitination.

You can also give your EAD copy to your employer now and start working on EAD as of last week of May and be on EAD till your I-485 approval. This way you H1B will not be required anymore.

Once you get your 7th year approval i think you can switch back to H1B as long as you don't change your employer check with your lawyer (but don't do this if this may cos a RFE on your case - just in case)
