i have a pending application in non-RIR case filed in oct.02. as it is taking long time, my company is now ready to file RIR case for me. But if I file now, all my waiting of 1yr 4 months will be wasted and the new application will be filed somewhere in march 2004. I am in a dilemma whether to accept for the new application or instead wait with the current non-RIR application.

please give your suggestions.

But this is my question:
I have already waited for 14 months. as I said now if I apply it is going to be in march 2004. and RIR is only in Mar2002. so the gap is 24 months. and nonRIR is now in May 2001 and the gap is 18 months. so is it worth to start processing afresh?

i heard from some people that non-RIR was stuck in April 2001 for almost 2 years because of the rule regarding the illegal immigrants. but now that it has moved to may, will it be good to wait for that?
 
Apply in RIR under some slightly different category/position that is what I meant.

And allow both to proceed. You can decide later.
 
i didn't get what you meant by different category.
could you pls explain...
can someone have both parallely? i thought one has to be withdrawn to start the other,
 
Here different category means different position/Title....

I meant you can apply for RIR from the same company even if you have Non-RIR case pending with DOL.

Use different Job title/position.
