Help please to sponsor child over 21

Hi i am filing the application for my Mon and dad to sponsor 4 of my brothers form South America. Both my parent are PR.

2 of my brothers have common law wife but not legally married. both have 2 kids each. can this still work. assuming the i130 approved how would my brother CL wife and kids be able apply to the application.

what is best way of doing this.

Your parents will have to become citizens AND your brothers will have to legally marry their CL wives in order to have their wives get derivative green cards.

However, with your parents being LPRs and not citizens, your brothers need to remain legally unmarried until your parents become citizens, otherwise the I-130 will be voided.

It will take some 8-9 years to reach their priority date, so that's plenty of time for your parents to become citizens before your brothers immigrate.
 
If you are a citizen, file sibling petitions. Marital status is not an issue.

What are the chances that the children's mothers would allow their children to be removed from their care knowing that the have at least a 5 year wait to be petitioned as a spouse after marriage? Problems establishing paternity are also an issue.

Sibling petitions take longer than married or unmarried children over 21.

If the OP is a citizen, he should file the sibling petition in addition to having the parents file for his brothers.

That's not going to happen, as there is more than enough time for his parents to become citizens and the brothers to get legally married to their CL wives before their priority date becomes current.
