Myself and my wife attended GC interview (employment based) and the interview went well and at the end of the interview the office returned our passports and EAD cards but did not return the I-94's. He took all I-94's from my passport and my wife's he took the old I-94. She is currently on H1 and did not have H1 stamping on her passport so we gave her current H1 approval notice (I-797) since that has the current I-94 at the bottom. He did not return that when we asked he said they don't stamp anything and he took our phone numbers and told he will give us call when visa numbers are available. When we asked again about my wife I-797 he said we should tell them it is with the immigration officer xxx at the INS office xyz.

Is this normal?? I am worried since we can not travel outside the country without the I-94's. My attorney told me not to ask the officer many times since it might complicate the case.

Any attorney please reply...

Are you sure?? If a person is on AOS pending can he travel in and out of country with Advance Parole without requiring the I94?
Will there be any letter sent as proof that we attended the interview??

I dont know about travelling but when we went for our interview, office kept our I-94, and she had left them on the table, so I picked them up as we were egtting up. She said we didnt need them anymore!! and took them from me. We checked with the lawyer and she said we were getting our greencards so dodnt need them anymore. Our interview was in May 05 so, we got approved in a week and got stamped in2-3 weeks time so didnt worry much about travelling without I-94.

I know they keep the i-94s, but your lawyer should advice you on travelling
