Help, please!! Complicated Situation..

Hi everyone,
This is my situation now, any suggestion will be highly appreciated.

My boss just informed that I will be laid off at the end of this month. I am using Sub LC under EB3 , and my 140 RD is Sep.2003, 485 RD. Jan.2004. My H1B will be expired on Sep.2005 ( my Sixth year).
Currently, i am trying to find a new job and negotiating with my company for supporting my GC process.
I think the chance for me to get RFE is pretty high since i am using the sub LC, here are my questions:
(1) If my company agree to support my I140, and I also can find a job asap ( the best situation I hope it would happen): just in case if i got RFE of 140 in the future, and they ask for the pay stubs for recently 3 month, and i have already transfer my H1B to new company at that time, Will my I140 be any problem if I submit the new company's pay stubs?
(2) I want to fax inquiry to CSC for my I-140 by myself right now, is it possbile to do so? I know the current processing time for EB3 is on May 28, so i am wondering will CSC accept my fax inquiry? Will I get any trobule for my I140 if i fax earlier than the ususal processing time?

I think ur best bet is to convince the employer to continue ur GC. Now this is possible but i dont have much info. So i would strongly recommend that you talk to a lawyer asap. Ask all these questions from him. Meanwhile some gurus will post the answers here too. But convince ur employer to continue ur GC ....

1. No problem.
2. 140's petitioner is your employer and you must have signed G-28 for it, so you cannot fax enquiry about the same.

Currently, my company said they will keep my status until the end of this May. I have no idea if they will revoke my I-140 or not after May.
I still didn't find a job so far, so my question is: if I find a job in june or july, and I don't have pay stub for May, is it still OK for my H1B transfer?

You definitely need pay-stubs, else you cannot get H1b transfer done.
