My sister got married to a Green Card Holder and she is here in United States on F-1 student visa and currently working for a company holding F-1 OPT (one year EAD) which expires December of this year. However, her husband is going in for a citizenship interview tomorrow. If nothing goes wrong, he should have his citizenship within next two months. Once he gets his citizenship, he is going to file Employment Authorization (I-765) and Petition for Alien Relative (I-130) immeidately for her. I have doubts that she is going to get the Employment Authorization permit and Green Card before this December so my questions are (1) Is it possible for her to extend her OPT so she can work while she waits on her status change? (2) If she can’t extend her OPT, can she still stay in US while she waits on her status change or does she has to go home? (3) Is there any other form other than I-765 or I-130 that she needs to fill out? What about I-485, the Application to Register Permanent Residence or Adjust Status? Does she needs to fill out this form?
