Help on Starting a Company while on H1B

Hi All,

I'm in the united states for the past 5 years on work visa (H1 B). My green card is in progress. Now while continuing to be on H1 B visa with my employer I'm planning to start my own company aside in which I will not be officially working.

If I start my own company (Say a LLC firm) can I be the member (owner) and operate or do I need a GC holder or US Citizen to be a co-member to run the show?

Thanks JoeF. That was quick reply. Yes as you said S-Corp can be formed only by US Citizens or PR's and the work visa regulations won't allow me to work for my own company. My I-485 is pending for more than a year, however due to some complications am not using my EAD even thought I have it.

At this juncture, how should I proceed in forming the company as I badly need to do it for not loosing my (business) resources on hand.

Joe I also wish to explore the possibility of opening a Company with one of my friend and we both are on H1 visa. So you mean we cannot open a company unless one of us is a GC holder or a US citizen? :confused:

Thanks for such a fast response. I need some more clarification on that. Me and my friend we work for two different companies (and are on H1) and we do not need a H1 from the company we are planning to form.

We were thinking of opening a software consulting company that could help software developers in getting consulting jobs. To be more specific my question was that: Can we both act as business partners and share the business's profit while staying as employees of our current employer?

Or we have to be GC holder or US citizen to run business like that! I hope I have not confused you with my question...Please let me know if I did!
